Terms & Conditions
Our Policy
These Terms and Conditions should be read along with the Estimate provided by On Point Groundworks Ltd (hereinafter referred to as “the Contractor”). The Contractor agrees to supply the equipment or perform the work as detailed in the Estimate at the specified price. The Client is considered to have accepted these conditions and entered into the contract for the supply of equipment or performance of the work outlined in the Estimate when the Contractor receives an Order from the Client, whether verbally or in writing, unless different conditions are negotiated and confirmed in writing.
Scope of Work
The Contractor agrees to perform the work or supply the equipment as detailed in the Estimate. Any additional work or modifications to the original scope must be agreed upon in writing by both parties.
Currency
Except as otherwise provided in this Agreement, all monetary amounts referred to in this Agreement are in GBP.
Payments
Payments shall be made in stages, as invoiced by the Contractor. The timing and amount of each payment will be specified by the Contractor.
Your quotation or invoice will specify the exact payment terms, including the deposit percentage and payments due at specific stages.
Interest on Late Payments
If the Client fails to make payment within 28 days of the due date, the Contractor is entitled to charge interest on the overdue amount at a rate of 10.00% per annum or at the maximum rate enforceable under applicable legislation, whichever is lower. All goods remain the property of the Contractor until fully paid for.
Site Meeting
To ensure clarity and effective contract performance, the Contractor and Client agree to meet at the construction site before work begins to confirm the exact size and location of the work as outlined in the Estimate.
Delays
If work is delayed due to bad weather, unsuitable site conditions, disputes with neighbours, delays caused by other contractors not mentioned in the Estimate, additional authorized work, strikes, lockouts, difficulty obtaining materials, or other unforeseen circumstances, the Client will grant a fair and reasonable extension of time for completion.
Site Access and Reinstatement
The Contractor will exercise reasonable care to minimize disruption caused by vehicles and equipment accessing the work area and to clear the site upon completion. However, the Contractor is not responsible for the costs of reinstatement. The Client must ensure there are no underground services at the site and notify the Contractor in writing if there are, as the Contractor is not liable for any damage unless notified in their presence.
Price Adjustments
The price quoted in the Estimate is based on costs and taxes at the date of the Estimate. The Contractor reserves the right to adjust the contract price to reflect any increases in costs or taxes beyond their control before work completion.
Disputes and Payments
In case of a dispute during or after the work, the Client cannot withhold payments beyond the reasonable cost of rectifying or replacing the disputed work.
Subsoil Conditions
The price assumes normal subsoil conditions. If unexpected obstacles like rock, unstable ground, excess water, or undisclosed services (water, gas, electricity, drainage) are encountered, the Contractor reserves the right to charge for additional work but will not proceed without notifying the Client.
Liability
The Contractor is not liable for any damage, loss, illness, or other claims arising from the use of the works specified in the Estimate.
Contract Termination
The Contractor may terminate the contract if: (a) The Client fails to make payment within seven days of receiving a written notice. (b) The Client becomes bankrupt or enters liquidation. (c) Work is delayed by the Client for four weeks or more. In such cases, the Contractor is entitled to payment for completed work and compensation for lost profit on uncompleted work. Further work under this contract will not proceed until a new Estimate is prepared.
Planning Permission
Some work elements may require planning permission. While the Contractor can assist, obtaining planning permission is the Client's responsibility.
Site Access Permissions
If site access is via a third party’s property, the Client must ensure all necessary permissions are obtained before work starts.
Dispute Resolution
Any disputes or differences arising between the Client and Contractor during or after the work shall be referred to arbitration by a competent person nominated by the contractor,
